To use our Independent Paralegal Service to have a paralegal complete all the documents necessary for a Legal Separation select one of the following:

File your Legal Separation in Lincoln County or Wahkiakum County and avoid a Court Appearance!

Divorce versus Legal Separation; what is the difference? In a divorce your marriage is dissolved, property and debts are divided, child residency and support is established and things like alimony/maintenance and restraining orders are ruled on. In a legal separation the court does the same thing except your marriage is not dissolved. Your finances are completely separated and one of you pays child support for any dependent children of the marriage. A legal separation protects you from any debts your spouse may incur after the separation without actually getting a divorce from your spouse, which may be against your religion. A legal separation may also allow you to stay on the other spouses health insurance unlike a divorce where as soon as you are no longer a dependent you have to get your own health insurance.

If both parties are in agreement you may use either county. If your spouse is not in agreement you should use Wahkiakum County. To learn more regarding the difference between the two courts, see: Lincoln County vs. Wahkiakum County.

Your legal separation lasts until one of you converts it to a divorce, the petitioner dismisses it or one of you dies. The legal separation cannot be converted to a divorce until 6 months have passed since the date of the signing of the decree of legal separation.
