Compare a Last Will & Testament, Living Will, and a Living Trust.

Last Will & Testament. This document is used to distribute your property to your beneficiaries after your death. If you have minor children you would also name guardians for minor children. Without this document you will leave these decisions to the laws and courts of your state. View our  Last Will & Testament  paralegal service.

Living Will. Also known as a Health Care Directive, it allows you to make important healthcare decisions if you become incapacitated. Such decisions as whether or not to remain on artificial life support, tube feeding, pain relief, etc. Usually a Health Care Power of Attorney appointing a family member or friend will be drafted at the same time allowing this person to make critical health care decisions if you are not able. Living Trust. We offer a Revocable Living Trust, which means you may revoke or amend it at any time. This allows you to transfer your property to your beneficiaries; yet, unlike a Last Will & Testament it is not usually subject to a probate court which can cost your beneficiaries thousands of dollars in legal and court fees. Our Revocable Living Trust allows you to transfer your property into the trust, name guardians of minor children, has health care powers of attorney, living wills, powers of attorney for finances, burial/cremation instructions and much more. An Amendment to a Revocable Living Trust is a written supplement, which alters or modifies the original Revocable Living Trust and is typically used when the proposed modifications are deemed minor and not of enough importance to justify rewriting the entire Revocable Living Trust, or when time constraints prohibit rewriting the entire Revocable Living Trust. An Amendment does not supersede a Revocable Living Trust but rather ratifies and republishes those parts in the Revocable Living Trust that are not changed. An Amendment to the Revocable Living Trust becomes part of the original Revocable Living Trust and the two are read as one document.
