In Wahkiakum County, you can obtain a legal separation without the need for a court appearance. You might be wondering what the difference is between a divorce and a legal separation. In a divorce, your marriage is dissolved, and matters such as property and debts division, child custody, child support, alimony, and restraining orders are settled. On the other hand, in a legal separation, the court resolves the same issues, but your marriage remains legally intact. Your finances are completely separated, and one of you will pay child support for any dependent children from the marriage. A legal separation also protects your property from any debts your spouse may incur after the separation, without the need to get a divorce, which may be against your religious beliefs.
Once both parties agree and your paperwork is filed, the court can sign the decree of legal separation.
Please note that your legal separation will remain valid unless one of three conditions are met: either one of you decides to convert it to a divorce, the petitioner dismisses it, or one of you passes away. It's important to keep in mind that the legal separation can only be converted to a divorce after six months have elapsed since the date of the signing of the decree of legal separation.
